Visior Visa

 
If you intend to stay temporarily in New Zealand, not study or work, you may need to apply for a Visitor visa. If you are a genuine visitor travelling to New Zealand and you are a Passport holder from one of the Visa-free countries, you may travel to New Zealand without the need to pre-apply for a visitor visa, provided you hold outward journey air tickets and have sufficient evidence of acceptable financial support (travelers cheques, credit cards etc) at the time of your arrival in New Zealand. A visitor visa of up to 3 months from the date of your arrival (except British passport holders who are allowed a visa for 6 months) will be issued at the entry airport. These visitor visas can be extended if you desire to stay longer.

For the other countries, you have to apply for a Visitor’s Visa when you are outside New Zealand before you will be allowed to travel to New Zealand. When you are granted a visa on arrival in New Zealand, you may remain in New Zealand for up to nine months (subject to your visa conditions), provided you meet the requirements for funds, health and character.

Once you are in New Zealand, you must remain on a valid visa and abide by the conditions of this visa, throughout your stay in New Zealand. Your visa will allow you to remain in New Zealand as a Visitor only. It is possible to change the visa terms while in New Zealand, i.e. you decide to undertake further study of longer than 3 months, which requires you to change to a student visa. If you then decide to obtain a job, this will require the granting of a work visa. This could then ultimately lead to you qualifying for permanent residence.

It is important to remember that applications for new visas MUST be lodged in the correct manner with Immigration New Zealand (INZ) before the expiry date shown on the visa. All visas automatically expire when the holder leaves New Zealand and a re-entry visa is required for the holder to return to New Zealand and be issued with a new visa. Visas are issued for either single entry or multiple visit entries.

Work Visa

Employers have recently become more frustrated with the apparent resistance of the New Zealand Immigration Service to grant Work Visas which would assist the employment of urgently required staff. The current economic climate contributed to numerous stumble blocks and as the New Zealand Immigration fall under the Department of Labor whose primary function is to maximize the employment opportunities and safety of New Zealand resident employees, they have been required to give stronger consideration to ensuring local unemployed are not disadvantaged. This can appear that the New Zealand Work Visa instructions may be seen as complex and unyielding, with discretion rarely granted. It is therefore critical that all care possible is taken with lodging your application with the relevant documentation and information required for a successful result.

In New Zealand, there are specific skill shortages that can be constant, seasonal or on the short or long term skill shortage. These are driven by demand, therefore change is inevitable. At the time off assessing your application, we can advise under which category to apply.

There are various categories under which to apply. Some fall under the Temporary category, while others may lead to New Zealand Residence. In all the categories, the health and character requirements need to be met. The various categories are:

Skilled Migrant: please see Residence

Temporary Work
This category is applicable if you have a job offer from a New Zealand employer, when you are skilled in an occupation that is in demand in New Zealand, or when you are coming to New Zealand for a particular purpose or event and people who want to gain work experience or work after studying in New Zealand.

Working Holiday
This may be applicable when you are aged between 18 to 30 years. New Zealand currently has arrangements with 30 countries allowing young people to obtain working holiday visas to travel to New Zealand to holiday and undertake work during their stay. There are annual quota limits on some countries (eg: 1000 places for China) but no limit on the numbers of people who can apply from the United Kingdom, Germany, Japan, Netherlands, Norway, Belgium, Canada, Denmark, Finland, France, Ireland, Italy, Sweden and United States of America.

Silver Fern categories
The Silver Fern visas are designed to attract young, skilled workers to New Zealand. The Silver Fern Job Search online visa application opens on 27 April annually. Successful applicants who come to New Zealand and find skilled employment will then be able to apply for a Silver Fern Practical Experience visa to stay and work in New Zealand longer.

Partnership Instructions
INZ instructions recognises a partnership relationship as one where two people are physically living together as a couple in a genuine and stable relationship. Whether a couple is married, or not, may be a consideration in determining the “genuiness” of the relationship but marriage itself is not a instruction requirement. Instruction does not differentiate between heterosexual or same-sex relationships and there are no English language or age requirements within partnership immigration policies. The sponsoring partner, as well as the applicant partner, must satisfy good character requirements. There are a number of policies which allow family members to enter, and remain in, New Zealand on either a temporary or permanent basis.

Work Instruction
Overseas passport holders who do not hold New Zealand residence MUST hold a valid and applicable work visa before they can work in New Zealand. There are a range of work visa policies which can be considered depending on the circumstances and only the main policies are discussed in this section:

Normal work instruction requires all the following criteria to be satisfied.
  • The applicant to have an offer of employment for a full time (30 hours per week) position which is in accordance with New Zealand employment law
  • The applicant to have work experience and/or qualifications relevant to the position requirements
  • The employer satisfies INZ, and provides evidence, that they have made a genuine attempt to locate and employ New Zealand citizens or residents for the position. This normally means the position has to have been advertised with no responses from suitable candidates. The position should also be one that New Zealanders are unable to be easily trained for
  • The employer should be credible and the position financially sustainable. It can be difficult to obtain work visas for positions such as those associated with customer service, cleaning, clerical, labouring and production work.
Work visas cannot normally be issued for any positions payable by commissions only, or in self employment (there are exceptions) or in any position within the prostitution industry. Work visas are endorsed to allow the applicant to work only in the position offered and only for the employer specified on the visa label. A new work visa application or a Variation of Conditions application is required to be approved to facilitate any change in the employment terms from those specified on the original visa label. Work Visas are issued for the period of the employment offered to an initial maximum of 3 years. All applicants must meet health and character requirements.

Work to Residence category allows you to get a temporary work visa as a step towards gaining permanent residence. Applicants may be qualified in occupations that are in demand in New Zealand, or may have exceptional talent in sports or the arts.

Talent (Accredited Employer) Work Category applies if you have a job offer from an accredited employer in New Zealand, you can apply for a work visa for up to 30 months under the INZ Talent (Accredited Employers) Work Category. When you have worked here for an accredited employer for two years you can apply for residence.

Applicants must:
   
a.
have an offer of full time skilled employment in New Zealand for a period of at least 24 months from an Accredited Employer for a salary of NZ$55,000 or more in the employer’s main business activity
   
b. be 55 years or younger
   
c. be able to meet registration requirements if this is required to take up the position in New Zealand.

Talent (Arts, Sports and Culture) Work Category - In this category an applicant with exceptional talent in a particular field of art, sport or culture, aged 55 or under and holding a sponsorship may apply for a work visa as a step towards residence under Work to Residence, Talent (Arts, Culture and Sports) Work Category. The application need to be supported by a New Zealand organization of national repute and be sponsored by either an individual or the organisation that supports you.

Student Visa

 
If you want to study in New Zealand, at primary, secondary or tertiary level, you may need a study visa. To obtain a visa, you must normally have a formal offer of enrolment from the institution, evidence of payment of the tuition fees, guarantee of accommodation and financial support for the term of your study and satisfy INZ that you are of good health and character and are genuinely intending to study.

We may be able to assist to lodge a visa application in your home country or when you are in New Zealand, we can assist in lodging a visa application. For extensions, we can help if you want to continue or finish your chosen study (Certain criteria need to be met). The New Zealand academic year is from around late January to mid December for schools and late February to early November of tertiary programmes and is for a period of 8 months.

Students who are enrolled in full time study, may apply to work for up to 20 hours a week part time and full time during the summer holiday vacation. If you graduate from a study programme with a qualification that is recognized under the Skilled Migrant Category residence instruction, you can be granted a 12 month graduate work visa. This visa allows a graduate the ability to seek, obtain and undertake work in any position with any employer without the normal requirement for a prerequisite employment offer.

There are also further opportunities for the partners of students undertaking full time postgraduate study or towards a qualification on the Long Term Skill Shortage List to be issued open work visas enabling them to work while their partner studies.

Business Visa

 
New Zealand’s business migration categories are designed to contribute to economic growth, attracting ‘smart’ capital and business expertise to New Zealand, and enabling experienced business people to buy or establish businesses in New Zealand. Investors
People wishing to invest funds in a business and live in New Zealand can apply for residence under the Investor/Investor Plus categories, or apply for a visitor visa valid for up to two years under our Temporary Retirement Category.

Entrepreneurs
Experienced business people wishing to purchase or establish a business in New Zealand can apply for a work visa under the Long Term Business Visa Category and then apply for residence under the Entrepreneur/Entrepreneur Plus categories.

Long Term Business Visas
Who is eligible for a Long Term Business Visa?
  • Business owners wishing to establish a new business or the purchase of an existing business.
  • nvestors wishing to purchase minimum of 25% of existing business in New Zealand.
  • Apply for residence under the Entrepreneur Category
Applicants need:
  • A satisfactory business plan and
  • To have sufficient investment capital to establish a business together with additional funds for maintenance and accommodation of the applicant and family and
  • Meet normal health and character requirements and
  • Establish that they are genuinely interested in the setting up of a business in New Zealand. Demonstrate ownership in or managerial experience in a relevant business.
  • International English Language test (IELTS) average 5 required
Business Plan
An effective business plan is essential to the success of an application under this category:

Applicants need to establish that they have sufficient capital to finance the business, have established a realistic budget, have relevant business experience, have not been involved in bankruptcy or business failure or fraud, and have carried out sufficient market research as to the establishment of the business in New Zealand.

Because of the importance of the business plan we recommend it be prepared by professionals and we are able to refer clients to appropriate professional accounting firms if so required.

Assistance can also be given to identify an existing business venture to purchase and for researching markets in New Zealand.

Important: It is essential that you have knowledge of the New Zealand Market and the requirements for doing business in New Zealand. The documentary requirements for this visa are substantial and we recommend professional advice. Investors will be granted a 3 year work visa and after running the business for two years applicants are eligible to apply for permanent residence status in New Zealand.

Employees of a relocating business
This category facilitates the granting of residence to employees of businesses relocating to New Zealand, who do not qualify for residence under any existing categories.

Residence

 
New Zealand welcomes new migrants – people who will contribute to New Zealand by bringing valuable skills or qualifications, setting up a business, or making a financial investment. It also offer opportunities for family reunification by allowing residents and citizens to sponsor family members for residence.

Skilled Migrant Category applies to employment in a range of occupations and industries in New Zealand where there is an acknowledged skill shortage. These occupations are reviewed and updated by INZ on a regular basis and published on their website. There are two listings:
  • The Immediate Skills Shortage List (ISSL)
  • The Long Term Skills Shortage List (LTSSL) - also known as the absolute skills shortage list
The ISSL generally applies to regional skill shortages and positions where short term national skill shortages exist. The LTSSL applies to nationally recognised skill shortages which are expected to remain for the foreseeable future. To apply under the Skilled Migrant Category, you must meet our requirements. You need to be aged from 20-55 (inclusive). You also have to meet INZ standards of health, character, and English language proficiency before you start the process.

Positions listed on the LTSSL can have additional advantages in applying for permanent residence.

The objective of applying under the Skilled Migrant Category is to provide for the grant of permanent residence to people who demonstrate the they have the skills to fill identified needs and opportunities in New Zealand and are able to transfer their accredited skills to New Zealand. They should also be able to demonstrate their ability to contribute to New Zealand both economically and socially by further demonstrating the ability to successfully settle in New Zealand.

Residence from Work category is for people who are already in New Zealand on a Work to Residence visa, and want to apply for residence.

Family Categories

Family Residence:
You may apply to come to New Zealand to live if you are sponsored by a family member who is already a New Zealand citizen and/or resident. You must be in one of the groups shown below.
  • Partner – you are the husband, wife, defacto or civil union partner of a New Zealand citizen or resident.
  • Dependent Child – you are a dependent child with a parent who is a New Zealand citizen or resident.
  • Parent – you have a child who is a New Zealand citizen or resident.
  • Parent Retirement Category – you have a child who is a New Zealand citizen or resident and you are able to invest NZ$1 million in New Zealand for four years.
  • Sibling or adult child – you are the brother, sister or adult child of a New Zealand citizen or resident.
If you are a New Zealand citizen or resident you may be able to support your partner's application or sponsor your dependent child, parent, adult child, brother or sister.

Family Temporary Entry:
If you intend to stay temporarily with your family member who is a New Zealand citizen or resident you may choose to:
  • Visit New Zealand under one of the following categories: partners of New Zealand residents and/or citizens; or culturally-arranged marriage; or dependent children of New Zealand residents and/or citizens; or parent and grandparent multiple entry visitor visa; or as a general visitor.
  • Work in New Zealand under partners of New Zealand residents and/or citizens category.
  • Study in New Zealand under partners and children of New Zealand residents and/or citizens category.
